How Missouri and Kansas tax sales differ

A house in Olathe and a house in Independence can both be behind on taxes. The legal path is not the same.

Three different paths in this metro

Standard Missouri counties here, including Clay, Platte, and Cass, use a tax certificate sale under RSMo Chapter 140. State law puts that sale on the fourth Monday in August. After a certificate sale, there is a redemption period.

Jackson County uses the court sale under RSMo Chapter 141. Confirmation of the sale is the deadline that matters.

Kansas counties, including Johnson and Wyandotte, use judicial tax foreclosure under K.S.A. 79-2801. The court is involved. It is not a Missouri certificate sale with a different name.

What does not change

On either side of the line, if we buy the house, back taxes can be paid at closing from the sale money. You do not have to be current before you ask for an offer.

Questions

Which page do I read for my county?

Start with the Missouri vs. Kansas page, then open your county page. Jackson is the one that does not follow the regular Missouri certificate sale.
